Who we are and what these terms cover
These terms govern your use of the GOTCHA website, including the PMC Framework (CFO) page, the GOTCHA Residency (CHRO) page, the Assessment Call page, and any invitation-only pages we send you (together, the “Site”). In these terms, “we” means GOTCHA, Kala Dawn Daniel and Kala Dawn Daniel Enterprises Inc. By using the Site, you agree to these terms. If you do not agree, please do not use it.
What the Site is, and what it is not
The Site describes our services and lets you ask to speak with us. It is general information. It is not professional, financial, legal, tax or HR advice, and reading it does not create a client relationship. A client relationship begins only when you and we sign a written agreement.
Illustrative figures and calculators
The calculators, charts, tables, quotes and examples on the Site use illustrative default figures and simplified arithmetic. They show how our method works. They are not forecasts, quotes or promises of results for you or anyone else.
Real results depend on your organization’s actual headcount, salaries and turnover, and on how a program is carried out. Only an audit built on your real data can estimate them. Decisions you make using the Site are your responsibility.
Unlocking content
Some content opens only after you confirm your email address. Unlocking is for you alone. Please provide accurate details, and do not share your access or forward unlocked content to people outside your organization without our written permission.
We may limit or remove access at any time, including if we suspect misuse.
Acceptable use
Do not use the Site unlawfully. Do not use scripts, bots, scrapers or other automated tools to reach locked content or to copy the Site. Do not try to bypass its security or the gate on locked content, interfere with how it works, or pretend to be someone else.
Ownership and permitted use

That includes the PMC Framework™, ORI™ Engine, GOTCHA Activations™ and GOTCHA Residency™ names and methods; the formulas, scoring approach and diagnostic methods behind them; and the text, design, charts and calculators. You may view the Site and use it to decide whether to work with us. You may not copy, republish, sell, adapt or reverse-engineer it or its methods, or use it to build or train a competing product, service or dataset, without our written permission. Nothing here transfers any ownership or license beyond this limited right.
What you send us
Details you give us through our forms are handled under our Privacy Policy. Please do not send confidential, personal or sensitive information through the Site’s forms, such as individual employee records or payroll files. If we need data like that, we will arrange it under a written agreement first.
Third-party services and links
The Site may link to or embed services we do not control, such as scheduling tools. We are not responsible for their content, availability or practices, and their own terms apply when you use them.
No warranties
The Site is provided “as is” and “as available.” To the fullest extent the law allows, we make no warranties of any kind, express or implied. That includes warranties about accuracy, completeness, fitness for a particular purpose, and uninterrupted or error-free operation. The Site and our offerings may change, move or be withdrawn without notice.
Limits on our liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of the Site or reliance on its content.
